it means that they are based out of newark they cant just go to any other town and start picking up fares all over the town they have to be operated out of that town and in kearny they are not. and yes their is in every town. this has been a problem for years and its getting worst it needs to be put to a stop those cabs are like roaches to the town of kearny and thats what they are

Huh?? What if someone calls from their house for a pick up? I see Harrison Cab in town also. Does this mean that they shouldn't pick up in Kearny either? Are you saying that people are hailing the cab off the street and they are picking up fares like they do in NYC? This makes no sense.

Naj, right, I was under the impression that in NJ you were not allowed to hail a cab like you do in NYC. But I never heard of cab companies only operating in the town they originate from.

I have a taxi man that lives right next door to me you can drop off in any town but need to have a town license to make pick ups and every town issues it's own

Taximan, # 1, lay off the CAPS; #2 you don't have to be so condescending; #3 further to Naj's question - how do you know that the taxis picking up in Kearny do not have a licence? Your analogy of Kearny PD pulling people over in NA is completely inaccurate as, unlike with taxi cabs, there is no license that would ever allow that. Also, you sound a bit prejudiced against certain taxi companies. What is your problem exactly? I live in Kearny and I have never seen any of these taxis from other companies chasing fares around town. Seems to me that if they have a licence to pick up in the surrounding towns, Kearny included, they should be allowed to do business in these towns and not be banned as you suggest in your original post/complaint above.

I never noticed they hang around, but I am not in town most of the day. I do see several different company cabs driving, I assume to a destination.

Yes I have lived in Kearny for the past nineteen years.

I live on maple st. And I can u the classic taxi (silver taxi ) are always parked just waiting around on corners of maple and woodland , they occupy parking spots and sometimes just are parked illegal . It is a problem .

So you are saying it's okay for a cab company to pay the town they are based out of all the licensing and certificate fees and could go to another town and operate all day in that town like they are based out of it? Last time I checked if you did that you were summonsed does that only apply to certain towns or certain people? Or Are those cab companies out of Newark paying off Mayor Santos and are allowed to get away with it ?

I should have clarified my response. In reference to the original complaint, below, the companies you are referring too ( classic, equamerica,gold lincoln) they are not taxi cabs they are considered car services.

i am a long life kearny resident and support kearny businesses my whole life can something be done to keep these newark taxi cab companys ( classic, equamerica,gold lincoln) out of town?? they do not have kearny licenses to be picking up nor should they be issued one this needs to come to a stop its been going on for years its also not safe for the community. further action will be taken if it doesn't get resolved

Town Ordinance 5-70A.4 requires no limousine (car Service) shall provide service from one point in the town to another point in town unless the owner thereof shall first obtained a permit from the town clerk.

Unfortunately 5-70A.8 is the exclusion which states shall not apply to limousine service (car service) which originates in another municipality and terminates in town, or which originates in town and terminates in another municipality, but all such service must be by prearrangement.

KPD traffic investigated this issue several years ago and was advised that per the ordinance we could not enforce this unless we shadow every car service with every pick up and drop off to see if the service is picking up in town and terminating service in town. This is nearly impossible due to based on calls for service and manpower issues. I provided below part of the ordinance but you can go to the town website and view the ordinance in its entirety. Hope this clarifies your complaint and feel free to contact traffic with questions.

Taxi Cabs are defined in the Town ordinance as:

5-70 TAXICABS.

5-70.1 Definitions.

As used in this article:

Taxicab shall mean a motor vehicle regularly engaged in the business of carrying passengers for hire, having a seating capacity of less than seven (7) persons and not operated on a fixed route.
(1973 Code § 129-1)

Limousines and Car Services are defined as:

5-70A LIMOUSINES AND CAR SERVICES.

All Limousines

5-70A.1 Definitions.

Limousine shall mean that term as defined by N.J.S.A. 48:16-13 and shall include car services.

Principal place of business shall mean the location of the main place of business of the limousine service where the limousine service is conducted, where limousines are dispatched, or where limousine drivers report for duty.
(Ord. No. 2009-19)

5-70A.4 Permit from Clerk.

Pursuant to N.J.S.A. 48:16-18.1, no limousine shall provide service from one point in the Town to another point in the Town unless the owner thereof shall have first obtained a permit to do so from the Town Clerk. When issued, the said permit shall apply to all limousines operated by that owner and providing intra-municipal service within the Town. (Ord. No. 2009-19)

5-70A.8 Exclusion.

Sections 5-70A.4 through 5-70A.6 shall not apply to limousine service which originates in another municipality and terminates in Town, or which originates in Town and terminates in another municipality, but all such service must be by prearrangement. (Ord. No. 2009-19)

Just because they say car service doesn't mean anything all of the cars are registered as TAXICABS look at the plates

They aren't marked as "TAXICAB". They are marked as "livery". The town literally explained the laws and quoted the statute numbers. It is perfectly legal for anyone to contact any service they choose to be taken to their destination. If you want to change the laws, run for mayor.

PattersonSt.... I'm guessing that's the street you live on ? of course you would go against what I'm saying because that's where all those "LIVERY" cars are parked at the @#$% end of town it's like Newark down that part nothing but garbage.
