This is a private property tree. DPW will address the branch in roadway. Code Enforcement has been trying to make contact with the condo association to have it removed.

As I understand it, when a neighbor's branch hangs over the fence into your yard, you have the right to trim the offending branch(s) AT THE FENCE LINE, and then you are stuck with the disposal cost to rid yourself of your neighbors out of control bushes/trees because CLAWSON CANNOT AFFORD TO CHIP BRUSH. Just because the dead tree may be rooted on private property it is not the property owner's responsibility to cut the branches hanging onto City of Clawson property. The offending tree is actually intertwined with the chain link fence on both sides. You would need a surveyor to determine ownership. The fence was there before the condos. Who owns the fence? If they cut the overhanging branches and dropped them onto an unsuspecting motorist, I think Mr. Kingsepp would agree that the City would be responsible for any property damage or injury. Does the private owner have the right to block S BATCHEWANA with orange cones to allow them the freedom without risk to drop the dead branches into the street?
I don't buy the excuse that the Code Officer cannot contact the condo administration. Any condo resident should have the phone number of the condo association. Do I have to do that part of the job too? I already swept the street to clean up the mess that the DPW left after they did their trim job.
