Zoning has denied other homeowners the chance to build a carport but why is this case deemed legal? The curb is jumped everytime a car is parked there

This is not new construction. This carport has been in existence for almost 10 years. This is deemed to be a legal use of this property.

This is extremely unfair to homeowners who are looking to make a new carport now. There is no proof that this was made before 2001. Please advise how a homeowner can make a new carport.
