Zoning has denied other homeowners the chance to build a carport but why is this case deemed legal? The curb is jumped everytime a car is parked there

This is not new construction. This carport has been in existence for almost 10 years. This is deemed to be a legal use of this property.

10 years previously would date back to 2006, which is after the 2001 Ordinance was passed not allowing new carports to be constructed. This is extremely unfair to homeowners who are looking to make a new carport now. There is no proof that this was made before 2001. Please advise how a homeowner can make a new carport.
