Here is the town ordinance for overnight commercial truck parking and overnight permit parking if the vehicles do not have a permit they are in violation. As far as parking during the day the only violation would be overtime meter or prohibited parking. I will have the parking violation officers take a look for violations during the day and patrol units for violations at night. Thanks.

7-15 PARKING OF CERTAIN VEHICLES PROHIBITED.

7-15.1 Parking Prohibited.

a. It shall be unlawful for the owner or operator of a truck (including without limitation vans and pick up trucks), truck tractor, trailer, semi-trailer, commuter van, school buses including Type I and Type II buses, omnibus vehicles (including taxis), motorized mobile homes (a vehicle equipped with sleeping, kitchen, or bathroom facilities), used for commercial purposes, as defined by N.J. Motor Vehicle and Traffic Regulations 39:1-1, to park such vehicles on any street in the Town of Kearny between the hours of 10:00 p.m. and 6:00 a.m. prevailing time.

b. It shall be unlawful for the owner or operator of a truck tractor, trailer or semi-trailer to park such vehicle on any residential street at any time except for purposes of pick-up and delivery.

c. It shall be unlawful for anyone to park any trailer or semi-trailer on any street in the Town of Kearny at any time unless it is connected to a power unit. (This provision shall not apply to dumpsters which are governed by Section 20-3 of the Revised General Ordinances.)

d. Any unoccupied vehicle or any trailer or semi-trailer named in subsection 7-15.1, parked or standing in violation of this subsection shall be deemed a nuisance and a menace to the safe and proper regulation of traffic; and any Kearny Police Officer may provide for the removal of such vehicle, trailer or semi-trailer. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle, trailer or semi-trailer. (1973 Code § 132-13; Ord. 7-33 OFF-STREET OVERNIGHT RESIDENTIAL PARKING FACILITIES.

7-33.1 Creation of Off-Street Overnight Residential Parking Facilities Program.

The Mayor and Council, by resolution, may designate for the development and use of off-street parking facilities for overnight use by residents in such areas within the Town as may be necessary to promote the intended purposes of relieving traffic congestion and making provisions for convenient off-street parking area for overnight residential use in order to facilitate the free flow of traffic. 7-33.2 Designation, Location and Operation of Off-Street Parking Facilities.

The Business Administrator from time to time shall make recommendations as to potential locations, or portions thereof, to be designated for parking facilities, which locations shall be considered for use as such facilities and shall cause to have located and installed at such designated facilities all necessary equipment and take all steps necessary for the effective operation of such facilities upon approval by the Mayor and Council. 7-33.3 Parking Permits Required.

Overnight parking between the limited hours specified by resolution for any off-street overnight residential parking facility shall be permitted only to persons who have obtained a proper permit as provided herein from the Town.

7-33.3A Overnight Off-Street Parking With a Permit.

The following are (i) areas designated as off-street parking locations for overnight use only by residents who have been issued a parking permit as provided for in Section 7-33 and (ii) the hours during which a permit shall be required at each location:

During the hours set forth above, any vehicle parked at any of the locations aforesaid which does not display the permit provided for in subsection 7-33.4d. shall be deemed in violation of this section and shall be liable to a penalty of not more than fifty ($50.00) dollars or imprisonment for a term not exceeding fifteen (15) days for each violation.

7-33.4 Permit Applications and Authority to Issue.

a. Applications for permits shall be available at the office of the Town Clerk. An applicant shall file a completed application with the Clerk who shall issue permits on a first-come, first-serve basis for each of the available spaces in each of the off-street overnight residential parking facilities. Applications will not be placed in the queue if they are not complete, not verified or do not include a signed Hold Harmless Agreement until such time as they are completed, verified and include the Hold Harmless Agreement.

b. Applications for parking permits pursuant to this section shall be provided only to eligible applicant who are residents or occupants of a dwelling within the area designated for each specific off-street overnight residential parking facility as more particularly described by boundaries indicated on the map depicting eligible residences to be determined for each facility.

c. There shall be an administrative fee of ten ($10.00) dollars for the issuance of a parking permit to any resident selected by way of lottery for issuance of a permit.

d. The permit shall be of a design and manufacture that will enable said permit to be affixed to the rear window and readily visible to the Parking Enforcement Officer through the rear window of the vehicle. Placement of the permit contrary to the aforesaid will cause the permit to be invalid and may result in the issuance of a parking and towing ticket at the owner's expense.

What about the Nu-Way Vending company vans and trucks that are parked every night on Bergen Ave by CVS? The signs say "No Parking Anytime" and they have a huge parking lot? Very annoying to say the least. Blatant disregard for the law and can't believe cops drive past them all night without writing tickets and towing these vehicles.

The issue that was brought up was the Boyd St lot. We will look into you complaint about Nu-way thank you.

Usually the painting truck is park there during the week at nights and the company isnt based out of kearny. The driver of truck leaves around 7am monday-friday.

So traffic needs to monitor this issue over weekend and during the weeknights as well

I live in the area as well and right now thats truck with the thing on top is parked on the street on corner of boyd and chestnut. So traffic would have to look out on street for it as well.

They did fix any issue. I came home at 10:40 last night and as i turn to chestnut from bergen i see the big white truck parked there, as i proceed down chestnut i get to the corner of chestnut an boyd an theres a brown creamer commercial truck there then i look in the lot for a spot an the painting truck is there. My wife called kearny cops to say something about it and the luitenet said hed send someone over. Well i leave for work at 6am and all 3 of those trucks are still in the same spots no tickets or anything and me a RESIDENT had to park all the way by mandees on chestnut when i live on boyd an wilson cause there was no parking. This town is a joke and they ticket and tow when they feel like it cause those trucks shouldve had tickets, actually better yet they shouldve been towed

Here it is after 10pm here i am returning home from work to no parking and the commercial trucks still in the same spots with no tickets or anything i spoke to my wife and she told me the painting truck left but of course its back in the lot, and the brown creamer truck hasnt moved at all. O traffic will monitor and ticket the issue. Thats completely bull traffic hasnt done anything and its said that when you call the cops they say o we will send a car over but yet no car was ever sent over.

Thats ridiculous.like how they do nothing and just keep closing this issue. Typical.

Thank you for bringing this issue to my attention, but facts before acts!! Officers have issued summonses to vehicles in and around Boyd St lot this week end total 15 tickets. As far as the Creamer truck that vehicle has been issued 19 overnight summons since July 2015 including three summons this weekend. KPD is aware of this issue and has taken action. Thanks again
