  Thank you for the inquiry, we'll have someone check on the location. The property owner only needs to keep the structures secured, clear the weeds, and keep debris to a minimum. In of itself, the property being vacant is not a violation of any City code.

  If you observe people behaving in a manner described by your inquiry, you could contact the Walnut Creek Police Department non-emergency line at 925-935-6400. The owner may have authorization to arrest paperwork on file with the Police. Absent this paperwork, the owner or a responsible for the property would have to authorize citations for trespassing.

  Thank you Matthew for the prompt update on this request for resolution. I completely understand it's not a code violation have to occupy your home but these dwellings are a safety issue for our community if left as is. I'm sure your inspector will find a good amount of "structures in need of being secured, overgrown weeds needing to be attended to, and debris cleaned up and kept to a minimum". Last I walked near this property there was an old truck with a full size tree growing out of it!! This can't be allowed per our ordinance and if so, it's time to add some language to the code. Giving kids and potential criminals a convenient place to congregate, do drugs and putting people hiking on the trail at higher risk of being in danger needs some immediate attention before someone gets hurt. Hopefully by putting this in writing it will help force what appears to be an aging issue for the better part of the last decade. Again, thanks for your prompt response, hopefully we'll see the same prompt action resolving the issue.

  Inspection of the property found minor weeds and debris present. The ownership will be contacted. The structures appear secured. Plywood on the inside or the outside of the windows is allowed. This secures the structures from reasonable access.

  Matthew - I think your inspector needs some new glasses or new career if this meets code as is... I took the liberty just now and went over myself to get you some photos and circled in red all the current safety issues, windows not secured, trash boards on the ground, property not maintained, etc. This can't be acceptable in our beautiful town of Walnut Creek where the average home price is 900K!! I look forward to hear the city's solution to this eye sore and safety issue right off the Mt. Diablo Regional Trail, a beautiful place to bring your family...

  Thank you for your comments. Minor weeds and debris have already been documented on the property and the owner will be advised of the findings of the already completed inspection. Per our local regulations, the owner only is required to maintain the property within minimum standards. Largely, secure the property against reasonable access, clear the weeds, and keep exterior debris to a minimum.

  Understood Matthew, that's why I sent you the additional 7+ photos showing you windows not boarded up, trash around both homes, especially the rear of each home, plywood building project scraps, someone's shirt hanging on the fence of an abandon building (RED FLAG that people are hanging out here as mentioned in an earlier post about school kids and some shady characters hanging around the property), etc, etc. You keep using the word "minor". Not really sure I understand. You'll also note the safety issues of the AC unit falling off the house, rear steps about to fall over and a roof that looks like it could collapse at any moment. "Minor weeds and debris", you must not be looking at the right photos. I even circled some of the issues in red. As asked above, what are you and the "code enforcement" team going to do about getting these torn down or properly and safely repaired (and I'm not talking about the weeds).

  As a whole, there is a not a large accumulation of debris on the property. I have seen far far worse than this location. The owner will be contacted and asked to remove it. There was no large concentration of rotting food stuffs, piles of household waste, etc. The items present, scattered across the front of the property, will be removed by the owner following their noticing of the documented issues.

  The landing at the door is not an issue at a vacant property which is not going to be inhabited or leased for habitation.

  Absent an interior inspection by the Building Department detailing grave building code violations following the owner consenting to their entry or from an Inspection Warrant signed by a Superior Court Judge, the City would not be in a legal position to force the demolition of a structure. The Chief Building Official would be hard pressed to prove to a Judge that the structures require demolition based on a cursory inspection of the exterior from the public right of way no closer than 17 feet away from said structure.

  There is no local or state regulation forcing a property owner to place a tenant in a vacant residence. Some of the issues you have referenced would be required to be repaired if the property were being inhabited.

  If you feel that the property is not being kept to your standards, you would be within your right to contact a group such as Bay Area Legal Aid if you already do not have an attorney on retainer. They can review what is needed for a demand letter to be sent to the property owner and the steps necessary to start a private nuisance lawsuit against the owner for what you feel are their deficiencies concerning property maintenance. City regulations do not force owners to match the standards set by neighbors, rather only a minimum standard.

  The property owner has looked into redeveloping the property in the past which included the removal of these two structures, but the then plan has not moved forward. The City does not determine when a property is redeveloped, that is the domain of the property owner.

  Matt - Still waiting for them to clean up the trash around the property reported here back in Oct (specifically photo 3 of 7 above). How much longer do we need to wait until the town sends someone to clean it up and back-charge the owner?

  Thank you for the inquiry. The owner's son has already performed removal of the items left behind by a transient.

  Absent a warrant signed by a Superior Court Judge, the City would not be able to remove items from the property.
