This is not fixed...garbage is still piled behind the garage!!!!! It would be nice if you made sure it really was cleaned up before you close this. This garbage piling has got to stop...very unsanitary & attracts unwanted rodents birds & bugs!!! & when it gets hot is gonna smell something awful!!!!!!
We will send a Notice to Abate but state law does not allow us to go onto property and open a gate to take photos or investigate a complaint, it is considered illegal search and seizure, nor would we be allowed to use your photo as evidence.
My husband saw one of the city trucks drive through the alley & he tried to stop the person to show him the problem but the truck just kept going. What good is this program if you can't use pics as evidence. Who else can I contact to help solve the problem?
It is not the picture itself, it is how it may have been obtained. Opening a gate to take a photo of something not on property owned by the picture taker is trespassing. Courts frown on that. If we (code enforcement) can't see it, according to the law in this type of instance, it doesn't exist.
At any rate, we spoke to the owner and they are going to have it cleaned up. If they weren't cooperative the photo provided would not have been allowed were we to take him to court. We can't accuse someone of a violation we can't see when it is behind a 6 ft. fence.
The fence & gate opened to take picture is our fence & gate. & some of the garbage is on our property so it is not trespassing. I am just happy that the owners agreed to get rid of garbage that's all we are asking. Thank you.
Apparently this neighbor doesn't want to be a good neighbor & remove garbage from our property so we are removing our gate so this can be seen from the street. Hopefully then the city or inspectors can help us solve this problem. We are good neighbors not wanting to cause problems but piling garbage anywhere is a sanitation problem. Lots of negatives can result from doing this.
