Hi Cheryl - The Town Council in May decided not to renew the lease at this property in part, because of the ownership situation, and the working conditions at the property. Over the summer the Town's program there should be relocated to the Alvin D. Higgins School facility. The issues previously noted via this website continue to be pursued with the owners. I have asked Town staff to provide an update here.

We do have an active case on this property. I have spoken with a partner in the LLC that owns the property. According to him the property ownership is being transfered within the next few weeks. Will will continue with our enforcement proceedure until the violation is corrected. If the ownership is transfered it becomes a new violation and the new owner will not be in violation of the Blight Ordinance for 30 days after the transfer. Closed in SCF.

Can you please leave this open with update on here so we can see the status? The own should clean up the property and then put a lien on the property. It seems as if the owner is neglecting the town rules. If the towns does this it will show that it means business and will cause problems for the owner which will be pay back for how he has treated the town.

It is Town policy to administer Property Maintenance enforcement procedures before spending money and time on cleaning and liening a privately owned property. The issue is further compliacted because the property is currently occupied. Clean and lien measures will be employed only after all other legal means are exhausted. Thank you.

The other incident said that they owner was contacted on May 4th (http://seeclickfix.com/issues/555420). Does this mean that fines started being levied as of June 4th? There should be at least $2700 in fines against the owner as of this point.

Or can he come in tomorrow, mow the lawn, and get away with this disgusting neglect? 30 days to acknowledge an obvious blight situation is FAR too long.

The Town's Property Maintenance Ordinance is based on State Law which provides a substanial amount of leeway to property owners. The process works like this:
A blight complaint is filed with the Town and an inspector is dispatched to verify the complaint
If the complaint is verified the owner is issued a 30 day notice to address the violations.
If the violations persist the owner is issued a Citation or fine
The owner can appeal the fine to a Hearing Officer, then a hearing must be scheduled
The Hearing Officer has the power to decide if the fines are warrented and if they should be assessed.
If the fines are assessed and the owner still decides not to pay the Town must file with the Court system to obtain compliance.
Some of these cases can take years to bring into compliance. It is a less than perfect system but the only one the Town can use.

How about the $25,000 owed on this property for taxes. It just seems that this is unacceptable. Tax paying citizens of this town have to deal with people like this who neglect and not pay.

Taxes collections are handled by the Tax Collector's office. I do not know the status of this property in terms of back taxes.

Hopefully it goes to auction and someone can actually start taking care of it.

That would be good for everyone involved.

UPDATE -- I have been in contact with a loan officer from Amerivcan Eagle FCU. They are scheduled to take possession of 138 South Rd within the next few weeks. They will clean the property shortly thereafter and make some improvements. The property will then be sold. This case will be closed in SCF
