The streetlight is able to light the street, therefore this tree cannot be declared a nuisance and is a private tree. The property owner is responsible for the maintenance of the tree.
SECTION 225.100: WHEN TREES OR SHRUBS DECLARED A NUISANCE
Any tree or shrub or part thereof located in, overhanging or interfering with the use of any highway or street in the City that, in the opinion of the Director of Public Works, violates the provisions of this Article or endangers the life, health, safety or property of the public shall be declared a public nuisance. The owner shall be notified of the existence of a nuisance and given a reasonable time for its correction or removal. If not corrected or removed within the time allotted, the Director of Public Works shall cause the nuisance to be corrected or removed and the cost shall be assessed against the owner or occupant and collected as provided by law. Regarding trees or bushes in making it hard to see traffic or pedestrian traffic in at the bottom of James McCoy Dr. next to Country Inn and Suits and right near the KATY trail. You have to go over the railroad tracks to be able to see if a person walking or on bicycle is coming to your left. ln the past I have cut them down but I feel the present property owners need to watch this area, to keep it clean and the area visible.
Maybe it is time the ordinance be updated to reflect that the city now has sidewalks. The street lights are just as important to the safety of pedestrians utilizing the sidewalks at night as cars driving on the streets.
