The fence is within the City right of way along the sidewalk 12", and needs to be moved back to prevent future damage. The City is not responsible for repairing this. 4/17/18.

City is changing the rules to minimize accountability. I was once told that 6 inches is the required setback.

The Department of Public Works has resolved this request. Unfortunately the fence post was damaged while plowing the snow on the sidewalk. The Right of Way on Cedar street is 49.5', DPW measured it today and the entire fence falls within the R.O.W. and therefore the city can not be held responsible for damage to private property installed in the right of way.
