Update from the Codes Compliance Department: City and County records indicate that the alley at this location is only 7 feet wide. A measurement from the fence in question to the opposite side of the alley shows a clearance of 9 feet, 11 inches. Therefore, there is no violation at this time. My complaint is not related to whether the alley is in violation of minimum width violation. The matter with which I'm concerned is that the fence extends beyond the addressee's property line. This in itself should be a violation. Is it reasonable to believe that as long as one does not violate any established minimums that a fence or structure could be placed beyond the property line without violation?

The Codes Compliance Assistance Department does not conduct surveys of properties or property lines. At this time, it has been determined that there is sufficient clearance in the alley and that the fence in question is not encroaching into the public right of way.

As a resident of Lang Ct. there is NOT sufficient clearance in the alley. The fence creates a narrowing of the alley that prevents emergency vehicles, moving trucks, sanitation trucks, etc. from entering. What if there is an emergency? Also, it is difficult to maneuver through this narrow area for day-to-day local resident traffic. Whether traveling north or south it is very difficult to make the turn at this narrow end of the alley. In order to enter or exit at this end, one must cut through the property on the other side of the alley or be forced into squeezing between the utility pole and the fence. Residents and others have scratched their cars many times. The scrape marks on this fence is evidence. This fence is an unnecessary impediment. To only consider whether the alley is wide enough to meet the minimum requirement or for a non-resident to conclude there is no issue is wrong. Why would this department ignore the simple, reasonable resolution and enforce the property line or recommend an agency that will? This is a legitimate claim that should be addressed. This fence should be removed or moved back to the addressee's true property line.

Update from the Codes Compliance Department: The survey team from the City's Engineering department conducted a survey of the property line and it has been determined that the fence is on private property and is not encroaching into the alley. Survey markings of the property line along the alley are visible and marked with pink spray paint. What is the process for requesting that the city enact the easement that exists for this property so we may have a functional space to drive? An appropriate radius clearance for turning is needed for the Lang Ct N and Calla Terrace N intersection.
