The staff on duty were advised of the complaint today. They report being the victim of vandalism to their portable ash tray/stand during overnight hour.
I'm not sure the explanation tells the whole story. The butts are in various stats of degradation which suggests something that's been going on for a long time. Shouldn't their license to sell alcohol be connected to maintaining the property?
Code Enforcement does not license businesses to sell alcohol. Our comments about this establishment have been forwarded to the City Clerk’s office who handles licensing.
There is a regular crowd smoking here. Discarded butts are a ubiquitous issue, but this is fairly disgusting (to the non-smoker, at least). I don't know what teeth Code Enforcement has, but if the patrons of the OP and other establishments along this stretch are responsible then the establishments themselves are complicit in the littering. I would like to see these establishments held responsible for the upkeep of the furnishing zone.
The Code Enforcement office has documented the property gets cleaned up, and then the same problem occurs right away. We have informed the Department of Public Works who issues properties an encumbrance permit to have business furniture or similar items on the City’s right of way.
This property is flagged for non-issuance of the permit due in April 2013 until a reasonable clean-up strategy is approved and implemented. We will close the issue when that occurs.
