"NEC 422.52 requires electric drinking fountains to have ground-fault circuit-interrupter protection. This protection can be a part of the fountain, included in the receptacle outlet or provided in the branch circuit."

The requirement for refrigerated drinking fountains to be GFCI protected was only added in 2008 (see http://ecmweb.com/content/code-changes-2008). A drinking fountain installed without GFCI prior to the requirement would be grandfathered in.
Is the water from that fountain cold, or do you ever hear the drinking fountain compressor running? If not, maybe it USED to be plugged in there, and was unplugged as a safety precaution because the outlet wasn't GFCI. In which case, presumably the outlet was to code at the time it was installed, and is grandfathered in.

210.8(B)(5) requires the following to be GFCI-protected: "Sinks - where receptacles are installed within 1.8 m (6 feet), measured horizontally, of the outside edge of the sink."
So, is a drinking fountain also a sink? If so, then 210.8(B)(5) might apply.
