"Not a building department issue" is not a resolution.
The question is why has the city allowed a main sidewalk passage to be "paved" with a material used for streets and not a real sidewalk. That is the issue and that question still has not be answered. You can ll pass this around but at some point it is still an unanswered question.

One of our Supervising Engineers did go by the site and they are using Street Print, which is also used in roadways, so I believe it will handle the pedestrian traffic.
2. Does this material meet code?
Asphalt sidewalks are acceptable unless there is a City ordinance that explicitly bans them.

ADA Accessibility and MUTCD guidelines would need to be met

Engineering did not receive any plans for this work, but the existing sidewalk surface in Pershing Plaza was asphalt prior to construction. Thus making it a replacement “in kind”.
5. What happens as the paint wears?
If there is an issue with the sidewalk the City would inform the owner it is their responsibility remedy the problem. There may be an agreement already in place.
Basically they can repair their sidewalk in kind unless the City has capital project to change the sidewalk…streetscape…also sidewalks have to meet all ADA requirement
