This is pretty bad walking conditions.

You can hardly call it a sidewalk.

Oakland Municipal Code section 12.04.110 requires that, with limited exceptions (that do not apply here), “[s]idewalks or driveways shall be constructed of portland cement concrete . . . .”

Because the owner previously apparently tried to patch the sidewalk with asphalt, it is clear that no permits were ever taken out because this would never have been allowed. The attempted repairs were illegal under the local ordinance.

Chapter 12.04 of the Municipal Code (“Sidewalk, Driveway and Curb Construction and Maintenance”) contains very strong language about sidewalk repairs and the possibility of liens on the property if any required fixes are not done in a timely manner. We just need the City of Oakland to use the powers that it already has in order to get this hazard remedied.

Neither address you give: 686 MacArthur Ave nor 696 Athol Avenue match the photo you posted. Please clarify!

This is the walk along to the three empty lots 661-669. I have written before re fixing the fence. These lots are used by the homeless as a toilet.

For our record:
I reported this same stretch of sidewalk (with photos) to Public Works by email on 6/23/2015. Then I called in a few weeks later to follow up and was sent an email with the service request #581137, and a note saying the issue was reported on 5/10/2015.

City of Oakland Public Works Department addressed this issue on 10/21/2015, service request # 604464.

This section of sidewalk AHS remained unimproved for years because it abuts neglected building lots. Many buildings above and below this spot have been vastly improved. These residents deserve safer walking conditions and a sidewalk which is kept up and weed free - or more realistically weed reduced!

If someone falls on this uneven ground who or what agency is responsible for the possible medical bills? This is quite unsafe and it is has been repeatedly reported but no action taken.

This has not shown even a hint of being addressed. The sidewalk is as buckled and cracked as ever.

C'mon Oakland, according to the tax records, the owner lives in the Fremont area. He's already losing $18,000 extra each year paying the Oakland vacancy tax for these three empty parcels on top of having to pay regular property taxes. What's another bill for him to make the sidewalk legal and safe?
