The chances that someone will get hurt here is minimal but if they do the exposure here is huge. There is rusted rebarb at the bottom of this pit. This will be a major law suit if someone gets hurt.
It has never been properly fixed, since Starbucks opened. You're correct Greg, this is a lawsuit waiting to happen. Thanks Vernon for reporting. I hope the city and the property owner will do the right thing and fix it this time.

I've been down this road before. The state owns the road and sidewalk. The state does NOT maintain the sidewalks in the city limit. City of Raleigh fixed a large problem a couple of years ago on the other side of the street, but still on the Falls sidewalk
The City maintains the sidewalk, but the sidewalk has been damaged by the erosion at this location. The cause of the erosion is a matter for NCDOT and the shopping center. City staff is attempting to bring these parties together towards a resolution. We will keep this issue open until it is resolved. Thank you for reporting and for your concern.
You all can point fingers at the DOT & the DOT can kick the can at you - the reality of it is that both entities will have to answer for this when a little kid accidently falls into this pit & punctures his or her lung. It will be a sad day if this is what it will take for someone to take ownership of this issue and repair this area.
Staff met with two members of the Public Works Department on site to inspect the failed sidewalk area while a rain event was underway on 8/31/15. Unfortunately the rain was not heavy enough to back-up the storm drain system in the area. Staff called the property manager and informed him that he need to excavate the sidewalk area, backfill with a suitable material, install 12” of stone subgrade for the sidewalk, mat the eroded area, and plant vegetation to control further erosion issues. Once he has completed these steps, Public Works will reinstall the sidewalk section. The issue is widespread and will require extensive work on the part of the property management to correct. The property manager understands that it was his responsibility to correct the issues on his property. Any issues dealing with the storm drain system within the Falls of Neuse right-of-way are NCDOT’s to handle. The City of Raleigh has no further responsibility except for the replacement of the sidewalk section.
