Greetings. A large tree that is on the property of our neighbor has grown tall and leans over toward our roof. The branches, fortunately,do not yet touch our roof. Our gutters are in danger of being clogged due to the close proximity of the leaves that fall from this tree.
We called the woman whom we knew was the owner. She bluntly told us that she was now divorced from her spouse and that she had nothing to do with the house. We could not get the contact information for the spouse. (There is a for-sale sign out in front of the house, and the realtor handling the sale appears to be the woman.)
We would like to know if the town can politely ask the owner of the house to trim the branches so they do not lean over our roof. We are not so much concerned about leaves in our yard, as much as our gutters being clogged. The branches lean over their fence into our air space. Is the owner required to do something?

We were asking if the owner was required to trim the tree, and if so, could the town require the owner to do so since we have been unsuccessful in getting the owner to do so. We are concerned that our gutters will get clogged from the leaves. The branches hang almost directly over the roof. If nothing can be done, then thank you for your attention.
