The home owner just finished the final touches on landscaping. It appears they have buttoned up the project and are done. The fence is clearly in the right of way next to a power pole, why would a variance be considered?

The homeowner is unable to apply for a variance to the location of the fence, as it may be located in the right-of-way, in which there is no provision for relief. Although the applicant will be cited for the location of the fence in the right-of-way and for the fence height, he has the opportunity to submit for a variance to the height of the fence.

Sure looks like a 5ft fence and an 8ft gate, but 12ft was pretty close. Jealously.....
