Description

Under Sec 78-202, ice cream trucks are not allowed to play amplified music. Under Sec. 78-171, they are required to get an annual inspection. At this inspection, please make certain that they have an unamplified bell and do not use amplified music. The ice cream truck in our neighborhood can be heard for blocks during the summer and many residents are annoyed by it.

Sec. 78-202. - Noise.

Under this article, an itinerant merchant shall not unreasonably disturb the peace and quiet of the city, and to this end itinerant merchants shall not shout or cry out their solicitation or blow any horn or utilize any amplification system or use any device to attract the attention of the public, except there may be a ringing of a bell, unamplified, so long as it does not unreasonably disturb the peace and quiet of the neighborhood.

Sec. 78-171. - Ice cream vendor license.

In addition to an itinerant merchant permit under section 78-164, ice cream vendors shall obtain an annual ice cream vendor license for each ice cream vending vehicle to be used in the city. Prior to the issuance of an annual license for ice cream vendors, the city building department and sheriff's department shall inspect each ice cream vending vehicle to determine whether it is roadworthy and complies with applicable state laws and city ordinances. An annual license decal will be affixed to the vehicle by the inspector upon successful completion of the inspection and payment of the annual license fee. The inspector will report the results of the inspection to the city clerk's office. Inspections will be performed during normal business hours by appointment.
