I apologize, wrong comment on the asphalt swale, Investigated this issue 4/27/16. No one at home. The property owner of the driveway can make improvements to his/her driveway by staying within the foot print of said driveway. If you wish to modify your driveway outside of the foot print, you must apply for a driveway permit. see this link for application if needed. Please let me know if you need any further assistance. J.
