Under the Oakland Municipal Code, it is illegal. Whether or not one cares is up to each person.
Technically, the recyclables become the property of California Waste Solutions from the moment you put them into the recycling cart so (subject to limited exceptions that don’t apply to most people) you don’t even have the legal right give away the recycling after that point.
Under Section 8.28.030 (“Collection of recyclable materials”), “[i]t is unlawful for any person other than the RR [residential recycling] collector or those persons employed by the RR collector to collect or transport any recyclable materials from SFD [single-family dwelling] or MFD [multi-family dwelling premises within the City” . . . .

Under Section 8.28.040(B) (“Ownership of materials”), “[t]itle to materials collected by the RR [residential recyclables] collector under the terms of the RR contract shall pass to the RR collector at such time as said materials are placed in a container and/or set out for collection provided, however, title to unacceptable waste shall remain with the generator unless expressly accepted by the RR collector.”
