Dear RJH,
The case is currently suspended because of two issues:
1) The trench was/is not sufficiently deep enough for cold patch to be used to bring it to grade (depth was less than ½?) so placing cold patch during the winter months was not an acceptable means of repairing the trench. The material would just kick out.
2) The trench is over 5 years old, and the personal guarantee that the original contractor would have provided has expired. Therefore the City DPW will be the using HMA (Hot Mix Asphalt) which the plants that produce this are closed during the winter months. Batch Plants were scheduled to open this first week of April.
