What you are referring to is a stormwater detention facility in a live stream. I had my staff review our recent inspections of this facility. We have inspected this in-line detention facility on a regular basis, in particular, in April, July and October of last year. From the October inspection, staff issued a report to the HOA with a list of maintenance requirements. The maintenance requirements were completed satisfactorily as evidenced through a follow up inspection in February of this year.
Our last inspection was March 25, 2011. We found the outlet control structures and the overall facility to be functioning properly. The stream is not stagnant.
Keep in mind that this is a flowing stream, so there should always be water; more water following rain events and gradual drainage of the basin.
Maintenance of this facility is the responsibility of the HOA, as it is on private property.
