Description
The new development on the corner of Sheridan and McClendon has this far failed to build a sidewalk as required by the Houston building code. The neighborhood could very much use sidewalks and will certainly have them built when streets are reconstructed in the future, so the city would be foolish to turn down tree sidewalks that are legally required.

I am not petitioning the city to build a sidewalk. I am asking why the city is not enforcing the building code which reads:
3110.4.4 Sidewalks. When required by Section 10.06D of the IDM, public sidewalks shall
be constructed in accordance the applicable Public Works drawing number, for the specified
location and site conditions.
Section 10.06 of the IDM reads:
D. Sidewalks and Accessibility Ramps:
1. Accessibility ramps shall be constructed at all intersections.
2. Ramps, approaches and sidewalks shall be comply with ADA and TAS requirements.
3. Approved sidewalk/ramp details are shown in the City’s Standard Details. Use of
these details are specific to certain field conditions such as ramp direction, driveway
crossings, crosswalk locations and the location of the sidewalk with respect to the
curb.
4. Where use of standard sidewalk/ramp details is not possible due to field conditions,
engineer shall submit proposed design drawings to City Engineer for approval.
Design drawings shall include site field survey conditions.
Clearly this development - which is about to finish construction - is not in compliance and we would like to know why.

"For the 1900 blocks of Sheridan (1951, 1955 Sheridan), a sidewalk variance was approved due to existing trees along the street. For 2015, 2017 McClendon Street, the variance was denied and a 5’ wide sidewalk is required w/ an ADA compliant ramp at the intersection."
My follow-up:
"1) What is the procedure for enforcement of the sidewalk requirement for 2015 and 2017? The sidewlak and ramp have not been constructed even though construction on the residences appears nearly complete.
2) On what basis was it determined that existing landscaping precluded the inclusion of a sidewalk along Sheridan? The only preexisting vegitation is a single crepe myrtle that does not appear to be in the way of a sidewalk located a few feet back from the curb and that should probably be removed anyway because it obscures the stop sign and street signs."
And in response to my follow-up questions:
"1. The inspectors have been notified and will inform those on site of the 5’ sidewalk requirement on McClendon Street.
2. From photos submitted by the contractors, there are existing protected trees along Sheridan Road that prevent a continuous sidewalk. Acknowledging the existing vegetation for the property in question, there are also existing trees further down the street that would prevent a continuous sidewalk by neighboring property owners."

You asked a fair question. The city didn't answer it. The procedure should be to enforce the permit they developer was granted. What happens if builder sells, goes out of business etc? Does city hold a bond that they can enforce? Did city erroneously grant certificate of occupancy before the developer was done?
That was just the McClendon sidewalk. Does Sheridan really have protected trees that prevent a sidewalk?
The whole thing just seems sloppy to me and the city responses not assuring...
