Description

Yesterday I received a $75 ticket for having a shrub extending more than 10" over the sidewalk. I was stunned. I have never heard of this violation nor have I received a warning previously. I was surprised too because the front part of my yard that was sited is a rock garden that is well maintained and is the frequent source of compliments from my neighbors. I routinely spend hours planting and maintaining the garden and at considerable expense. Are we to be gardening with a ruler and cutting down plants like rose bushes when they lean towards the light? Is there any consideration given to aesthetics? I walked around my neighborhood and see many lovely hydrangeas, rosebushes, salvia and other plantings that extend over the sidewalk. If these were weeds I can understand. I would hate to see the neighborhood begin to look like gardenless South Philadelphia.
Can reason and judgement be employed in this process?

Do I have any recourse other than to schedule a hearing?
