Per city and city consultant research last year, property owners have rights to the center of that street.

There is nothing marking who posted the sign. It could be someone who does not have property rights. I request the investigation of the sign in-person, determination of who posted the sign, and a mediated conversation with that person and a member of your staff.

Harris Street is unaccepted, meaning that the City does not maintain the street, but we will look into this further to verify if it is a Private Way. If it is a Private Way, each resident would control the property in front of their house to the middle of the street. If that is in fact the case, then as long as the resident who posted this sign did so on their own property, there is nothing we could do to have it removed, as it would be a privately owned sign on private property referring to cars parked on their property.

Thanks for your continued attention. My children love watching trucks out the window and it's crushing me to see so many cars damaged by the towing company and then taken away. A couple things: 1) Based on an email conversation with the mother of a resident of 6 Arcadia Street, I suspect that the owner of that building posted the sign. The question is then whether a property owner who does not have a Harris Street address actually has property rights on Harris Street. I cannot verify for certain that the sign was posted by this person and request an investigation by your office. 2) The sign does not state the parameters of the tow zone. Cars have been removed that were parked just under the sign as well as a full car length 's space away. Boundaries are undefined. 3) The sign does not specify what "unauthorized vehicle" means. I worry that a family with a handicap placard--such as we have-- would be towed. 4) If the owners of the properties on both sides of the street claim rights to the center of the street and park there, an emergency vehicle would not be able to pass through. I thereby request an assessment by emergency services as to the legality and safety of this policy.Thank you so much for your time!!! - Katie

Circling back and close this issue out. The parcel that contains 6 Arcadia St also contains 20 Harris St, so as long as the same person owns the entire parcel, they do have property rights on Harris St. It is up to all of the property owners to agree on how parking will be monitored and enforced. Regardless of the legal property boundaries, cars cannot be parked in a way that leaves less than a 10' travel way for emergency vehicles. This regulation is enforceable by the City, and any vehicles blocking the street can and will be towed.
