The Whiskey Rhythm Saloon is operating sound amplification equipment that is plainly audible from both the Embassy Suites hotel and the Bristol on Broadway condominium property lines. This is in violation of Subsection "A" of Municipal Code 11.12.07.

The Whiskey Rhythm Saloon is located at 1811 Division Street and is zoned MUI-A. (See attached exhibit, p.1 for a copy of the Whisky Rhythm plat).

MUI-A zoned properties like Whiskey Rhythm Saloon are subject to SUBSECTION “A” of Municipal Code 11.12.07, which states: “…it shall be unlawful for any person to allow the operation of any sound amplification equipment so as to create noises that are plainly audible from the boundary line of the nearest residential occupied property.” And that “plainly audible means any sound which clearly can be heard by unimpaired auditory senses” Moreover, “…operation of any sound amplification equipment for advertising purposes or otherwise to attract customers so as to cause sounds…plainly audible at or on the boundary of the nearest public right of way [is unlawful].” (See exhibit, p. 2-4 for copy of Municipal Code 11.12.07).

In addition to the the sound amplification equipment, Whiskey Rhythm has placed outdoor advertising signage on the sidewalk, impairing pedestrians and causing them to walk on the highly trafficked street. (See attached exhibit, p.6-7 for images of an additional external amplification speaker that broadcasts recorded music, and an image of the pedestrian right of way sign blockage).
