Concern was not about erosion control. Concern was about failure to protect critical root zones of remaining trees during grading. As photo shows, protective fencing was removed for grading.
I agree with Stan. In this case the tree protection fencing was removed, grading was done into the critical root zone as shown in the photo, and then, after the complaint, the fencing was put back up. The whole point of tree protection fencing is to establish an area where grading or other construction activity is not permitted! This happened after the builder was allowed to well in excess of 75% of the existing tree canopy in violation of the intent of the tree ordinance apparently using a loophole in the ordinance. The message to the neighborhood seems to be that maximum development trumps (word intended) tree protection or other environmental concerns.
