Has this property owner been contacted? This is not really a code issue however, I can refer the owner with information to the Mt. Diablo Bee Association or a private entity for the removal.

Yes, the HOA did send letters to the homeowner. However, since it's an issue within the walls of the homeowner, the HOA feels it's the homeowner's responsibility to fix

If not an issue regarding any code violation, I'll just have the HOA continue our process

I find it hard to believe that this potentially dangerous situation is not a code violation. The HOA cannot ultimately compel the home owner to have the bees removed. The city must be able to. They represent a hazard to public and the owner has thus far refused to do anything about it. It's not likely that the situation will improve on its own. I feel that ultimately the city must compel the homeowner to take corrective action in the public interest.

I spent about 15 minutes at the property today talking to the son of the owner. During that time, I saw two (2) bees. Not a swarm and not a "dangerous" condition. They are in the process of obtaining quotes to have the situation taken care of. I am not aware of the process that the HOA has initiated in trying to resolve this mater however, it does not appear from my contact with the owner and her son that they are "refusing" to take action. At this time this is not a dangerous condition and does not require the City to take action. I provided my business card to the son in case he has any questions that I may be able to assist him with.
