It is obvious that fence pictured appears to be old and existing, and is not something the Construction Code Office is going to pursue as a violation. Unless you can demonstrate that there is a recorded easement that would preclude the existence of any structures within that designated area, and that it would guarantee your use of your neighbors property in any capacity, this is a non-issue.

As you can see from the land survey, the gate has been there for some time, however it was only slightly over the property line. He has extended it within the past week to close off the entire yard of both properties.

As previously stated, this is an old, pre-existing fence. The property was visited in person to ensure that nothing has been newly installed. The fence is located just as it is indicated on this survey. This is a closed issue.

I find it intereating that the property was visited since all access to the yard has been sealed off by Mr. Bachanus. However, thank you for your time. The area was viewed from the parking lot of the apartment building behind you, on the other side of the block. From that vantage point, the whole rear yard area was completely visible, and there was no need to gain access from the Grant Ave. side. Further more, Mr. Bachanes was contacted and spoken to personally, to ensure that no work had taken place or was planned. He also offered full access to the rear yard if necessary.
