There are several issues here, with this complaint. First, the "Kearny/East Newark border" is not an address. Without a specific address for where the noise was originating, we would have no way of researching our file to determine whether or not any work should be occurring at any particular address. At this point, this office has no idea whether the work was at a residence, if it was emergency work by a public utility in the road, or even if it took place in Kearny (where we would have jurisdiction). Second, your statement in all caps insinuates that the Town knew that construction work was taking place at that late hour. Town Ordinance 4-16.2 prohibits any construction work after 8:00pm, and/or the use of domestic power tools in residential areas after 10:00pm. Unless it's emergency work, and/or specifically approved by the Mayor and Council, no work should be taking place after those hours. Third, the Construction Code Enforcement offices close at 4:00pm daily. So, there would be no one available at that hour to know that there was construction work and/or a noise issue. Noise complaints are enforced by the Kearny Police Department. If there are issues with noise at that late an hour, the Kearny Police should be notified immediately. Any additional information you can submit to help resolve this issue would be helpful.
Upon inspecting the area, it was determined that the noise was generated as a result of work being performed on the railroad tracks that run along the Kearny/East Newark border. The property is railroad owned, and is regulated by the Federal Government. The Town of Kearny, unfortunately, has no jurisdiction.

I called the county and they told me to call my city's town hall, I said that the town hall told me to call you, and they said "I don't know what to tell you sorry"
I don't know who you talked to that would have sent you to the County, but they have nothing to do with this either. It's railway property, regulated by the Federal Government. Our records show Norfolk Southern Railway, in Norfolk Virginia, as the property owner. We have no other contact information, or phone numbers, that might be helpful.
