Due to the zoning for this area regarding the noise ordinance, this area of Demonbreun St may (need to confirm this) fall under the same guidelines as establishments in Downtown Nashville. Please know we are working with all the establishments along the Demonbreun St area to ensure they are aware of the residential area across the street. Starting this evening we have been making contact with these establishments and they have complied with ensuring they monitor their establishments activities. Your concern will be something we will be monitoring very closely over the next week or two, checking different nights of the week, including Saturday nights, which is the evening you had your experience. Upon further research into this complaint, I've found that both sides of Demonbruen St. is "Zoned" the same as it is downtown along Broadway and 2nd Ave. So, the same rules apply on the Night club side of Demonbruen as does the new residential area side. Your concern is a valid one. No one wants to be disturbed in the middle of the night. However with the zoning for this area I have limited tools in my tool box to address this issue. But what I do have is the ability to enforce a noise ordinance. The ordinance requires a business that's projecting music or other noise to not exceed 85db to be measured from 50 ft from the nearest corner of the business property line. The precinct is acquiring multiple "Decibel Meters", so we can start spot checking these businesses on different shifts and on random nights for compliance. I have also talked to management of the "Harp & Fiddle" and expressed your and our concerns related to the noise level and times of night. They stated they would review how they employ the music and attempt to bring the levels down. There was even talk of turning speakers away from the street so they would project back into the business. We (Metro PD) will continue to monitor this issue and enforce any violations. However with that being said, violations can only be addressed through the issuance of a Metro citation which can be paid off before court. The fine for violation of the ordinance is $50.00.
I would suggest that you also reach out to your Councilman (Freddie McConnell) and ask about the need to have your residential area zoned differentially, or up the fines for these violations.
