The Health Dept. checked this property today at approx. 11:00am. There was no violation at this time.

I'm sorry, but perhaps you all looked at the wrong property. 97-99 Davis Ave, newer house directly across from the Franklin school. The lawn is so overgrown and full of dandelion weeds that you most likely can't see the garbage in it. The grass that is supposed to be in between the concrete driveway strips is all dirt with garbage embedded, and the car parked there is hiding the rest of the garbage and uncut grass. Kearny requires a % of the front property to be grass...not dirt and garbage. If new zoning requires a % of grass, aren't homeowners required to maintain the property. All the other houses on the street are well kept but that one. And I suspect given the condition of the front that the back yard is very likely just as unkempt. Perhaps the home owners just need to be reminded by the town that they are responsible to maintain their property - mow their lawn regularly and pick up the trash that blows in or is dropped there. Please take a closer look. This will affect property values on the street. Thanks very much.

Dandelions and dirt are not violations. There was not a violation on the day of inspection.

Actually, that's where you are wrong. According to Kearny town ordinance, Chapter 17 Property Maintenance, Section 17-1 Trash, Brush, Weeds, Obnoxious Growth, Subsection 17-1.1 Prohibited Accumulation; Growth, "It shall be unlawful for any owner...to allow to accumulate or remain there on, or permit to grow there on, brush, weeds...obnoxious growths, filth, garbage, trash and other debris, or any other offensive or unsightly matter and material. (1973 Code 58-1)" The property directly in front of house 97-99 Davis is unmowed, overgrown with "weeds" (yes, dandelions are weeds), and laden with garbage that has been blown or strewn in the yard. So are the planting beds in the retaining walls. It was like that on the day of the inspection because the owner hasn't maintained anything on the outside at all this year. Plus the dirt that was grass in the driveway has garbage embedded in it. We are not talking about the property between 97-99 and 101 Davis; that is maintained by the owner at 101 Davis. If your department is not responsible for enforcing the Property Maintenance ordinance for the town of Kearny, kindly advise who is. Thank you.

I've attached a picture of the property in question. And this is just one area. This doesn't capture the driveway trash, unweeded retaining walls or the rest of the yard. You are honestly telling me that you have enforced this code for "over 30 years" and the attached does not constitute a violation? There is trash strewn in the yard, and it's never mowed. It is both " offensive and unsightly". Again, I believe a mistake was made when the property was looked at 2 weeks ago. Please reinspect. Thank you.
