It seems that the replacement should be like-kind in the contract and not a replacement that worsens the appearance of the intersection. If they replaced the entire intersection instead of only the portion they tore up it would have entailed another 20% more of material and it would have been a seemless repair. It's like me repairing a wall in your house and painting the my patch a different color.
I'll close, but we should remember to check back at project completion since it's 2 years from now...

THIS WAS A CONDITION ON THEIR PERMIT BECAUSE IT IS A WORKING WORK ZONE FOR THE NEXT 22 MONTHS. DOESN'T MAKE SENSE FOR US TO RESTORE THE AREA AND BE IMPACTED WITH ALL THE CONSTRUCTION TRAFFIC. THE ENTIRE SECTION OF EVERNIA INCLUDING THE INTERSECTION OF EVERNIA AND ROSEMARY WILL BE RESTORED.
