Thank you for looking in to this issue. I am a little surprised that the subject homeowner could restrict the city from clearing the natural drainage of this water. This path of water flow has been in place for years. The homeowner has neglected the area in question and it has now formed a dam, thus stopping the flow of water that comes across my property and other properties upstream from my property. If it is acceptable for the homeowner in question to do this, can I then build a dam to keep the water from flowing across my property and then flooding the homeowners upstream? I would not think this is acceptable and have no intensions of doing so. The city at one time installed a culvert in this location because this "is" the natural flow of water across the properties in order to exit off the side of the mountain (Monte Sano). I would think and expect the city to have the authority to override the subject homeowners decision to let vegetation and trash build up and block the natural flow of water.
