This issue is not closed- just today 10/28/12 I saw three suspicious looking men slink through the hole in the fence at dusk.

If this really allows access to the vary tracks and there is really no other fence keeping people off the BART tracks this is an emergency and you should call BART Police immediately at 510-464-7000. If this just allows direct access to the CALTRANS right of way, call them direct for the repair status. The City of Oakland doesnot track CALTRANS repairs.
