I have also hit a pothole on Henry St in Commack which blew out my rear right side tire. After calling the town of Smithtown, they informed me that this indeed was a private road and had referred me to PJ Venture, the real estate company that owns the Costco/Guitar Center/Target lot on Henry St. After leaving a message for someone at PJ Venture, they returned my call and claimed that since the pothole is on the west side of Crooked Hill Road, the responsibility falls under the Commack Cineplex management, which is no longer in business. I've since tried calling Lowe's corporate offices, (whom has purchased the property and assuming the portion of Henry St.) and I'm currently awaiting a returned phone call.

Does anyone know if the town has the authority (a law on the books) to fix the problem and go after the owner (with a bill/lein)?
I've heard of people not cutting their lawns and towns cutting it for them and sending them a bill (something like $300).
