Oakland has spent a lot of the tax payer's money on building bike infrastructure. We're still way behind San Francisco in this respect, but we need to defend what we have. This business uses the bike lanes as its own private driveway. This is illegal and needs to be stopped. We need some enforcement here.

Jinto, the California vehicle code allows drivers to enter a bike lane in only two circumstances: 1) When preparing to make a right turn (after signaling and yielding to bikes in the lane) and 2) before entering a curbside parking spot (also after yielding to bikes in the lane). Stopping in or blocking a bike lane for any other reason, including very brief stops, is not legal and could result in a citation.
That being said, you are correct that this photo alone does not prove that the driver of the truck wasn't in the process of legally preparing to turn or enter a parking spot. However, I also know this truck as it is parked in the bike lane almost every morning, even when other legal parking spots are available nearby. This is an long-standing, ongoing problem, not an isolated issue.
If the business needs a curbside loading zone at this location they should petition the city for one, not make their problem someone else's problem by blocking the bike lane instead.
