Yellow curb painted at driveway entrance to White Cap Construction Supply (6707 Washington St NE). No signage or "no parking" is painted on the yellow. White Cap has graciously allowed parking in their lot and in front of their business for Saturday and Sunday services. Every six months police ticket vehicles, yet when we ask police officers inside the church they tell us parking is OK, even on the yellow. Please expound on the City of ABQ yellow curb parking ordinance in layman's terms; we have not been able to find any information. At a recent ticket, even the city prosecutor dismissed the ticket, simply rolled his eyes, and could not provide any information / source for the ordinance. (code 8-5-1-1A). Congregants desire to continue having the privilege to park at White Cap and in front of the business for Sat and Sun services. Where can a layman locate to ordinance information. Curb markings are generally ordered by the Traffic Engineering Department at the request of a business, neighborhood, or private citizen after making a determination of necessity.
The ordinance is published by American legal Publishing online for all City of Albuquerque ordinances.
Here is the applicable portion of the ordinance.
§ 8-5-1-1 STOPPING, STANDING OR PARKING PROHIBITED NO SIGNS REQUIRED.
No person shall stop, stand or park a vehicle except when necessary to avoid conflict with other traffic or in compliance with law or the directions of a police officer or traffic control device, in any of the following places:
(A) Next to a curb which is painted either yellow or red.

I would suggest contacting the City Traffic Engineer, John Kolessar; he is generally very responsive.
First you need to contact White Cap Construction Supply and gain their cooperation.
Having correct information about the original installation (painting) of the "yellow curb" for the specific location may be difficult to obtain. Records prior to the last five years may not be available.
My first guess is at some time White Cap Construction Supply or its predecessor requested the yellow curb marking so as to prevent parking too close to the private driveway. Normally the City of Albuquerque regulates parking near a private driveway to within three (3) feet, however because of the type of vehicles entering the property that may not have been sufficient. Though White Cap maybe cooperative and intends to let you park, the City ordinance supersedes that intent because the parking is along a regulated municipal way.
The officers are doing their job, they see a yellow curb and a vehicle parked they rightfully issue the citation. If a police officer is telling you otherwise, then I would respectfully suggest the officer review citation procedures.
Composing a letter to the City Traffic Engineer with the cooperation of White Cap and demonstrating the Court (Judge / Prosecution) has consistently dismissed these citations may provide compelling evidence in your favor. You can obtain copies of the citation dismissals by going to nmcourts.com assuming you know the names of the person's cited.
All of this is costing taxpayers money if it is not necessary.
